BLOOD ON KAGAN’S HANDS?: DOJ Attorney: She “Manipulated Science” to Lift Abortion Ban (Guests in EDT)

While most political pundits who take a moment to project on the Elena Kagan confirmation hearings for the Supreme Court assert that it is by and large a snoozer waiting for a rubber stamp, some individuals with more firsthand knowledge of her background are trying to raise red flags.

Among them is a former attorney with the Department of Justice, who wrote an absolutely startling article on an outside-the-mainstream-media blog (see the link below).

For anyone paying attention to Kagan’s record—including CleanTV contributors Mary Balch, Lori Kehoe and Dorothy Yeung of the National Right to Life’s State Legislation Department—the content of that article isn’t nearly as surprising as the fact that it doesn’t appear to be enough to stop Kagan’s confirmation.

In summary, the article reveals how Kagan herself, while deputy assistant to the President for domestic policy under the Clinton administration, revised a report put forth by the American College of Obstetricians and Gynecologists (ACOG) that said there were no circumstances under which partial-birth abortion “would be the only option to save the life or preserve the health of the woman.”

Following this report, Kagan wrote in a memo response to the Clinton White House—exhibit A—that ACOG’s determination would be a “disaster,” then proceeded to rewrite the statement to reflect the opposite, which she contends was more accurate of what ACOG really believed.

Kagan’s version wound up in the official report, which then played a key role in the Supreme Court’s decision to strike down Nebraska’s partial-birth abortion ban.

In Kagan’s hearings last week, Senator Orrin Hatch (R-UT) addressed this issue with Kagan. Mrs. Kehoe has lobbied Congress on abortion, euthanasia, cloning, health care rationing, and other pro-life and First Amendment issues. She has conducted seminars and has spoken on the life issues across the country and throughout Australia. Mrs. Kehoe has appeared on C-SPAN, CNN, Fox News Channel, and other national television and radio programs. She is a graduate of State University of New York at Geneseo.

Dorothy Yeung, J.D. is legislative counsel for the National Right to Life State Legislation Department. She also serves as a lobbyist for North Carolina Right to Life and chair of Triangle Right to Life, the Raleigh-Durham-Chapel Hill area chapter of National Right to Life. Mrs. Yeung has appeared on many national and international news broadcasts including Fox News Channel, MSNBC’s Hardball, CNN's Crossfire, NPR’s Diane Rehm Show, and programs on ABC, BBC, National Irish Radio and Voice of America. She is a graduate of Regent University and a Blackstone Fellow.
