SUPREME GAUNTLET: Obama's Agenda, Arizona Lawsuit Points to Showdown With Highest Court in the Land

With the Democrats in control, Congress is seemingly content with handing many of its powers over to the Executive Branch. Conversely, despite Barack Obama having the rare opportunity of nominating two Supreme Court justices early in his first term, it is the Judicial Branch that seems to be getting under the president's skin; rulings that fly in the face of the Obama agenda continue and there may be more on the horizon.

The latest in a long line of salvos being fired between Obama and the Supreme Court is news that the Federal government has officially filed suit against one of her states – Arizona – over the issue of immigration. Arizona's immigration law SB 1070 doesn't even go into effect until July 29th but this lawsuit portends another showdown between the Obama administration and the Supreme Court, a place where the lawsuit is ultimately going to be decided.

Seasoned lawyer and one time candidate for the Kentucky Supreme Court, Marcus Carey has been watching - with a trained legal eye - the relationship between Barack Obama and the Supreme Court, led by Chief Justice John Roberts and ideological lines seem to be getting drawn. Decisions have been going against the Obama agenda by a score of 5 – 4 lately. One of the Justices Obama would have to replace in order to change that, Anthony Kennedy, has publicly stated he will remain on the court until at least 2013.

Some very visible friction between Obama and the Supreme Court was on display in January, at the State of the Union when the president publicly chided the court for its 5-4 decision in Citizens United v. FEC. The ruling had the effect of striking down a large portion of McCain / Feingold, allowing corporations to express public opposition to political candidates in the form of marketing documentary films. Supporters viewed it as a First Amendment victory. Obama viewed it as an affront to his authority.

Another 5-4 decision that went against Obama was the recent decision in McDonald v. Chicago, which reaffirmed Second Amendment rights by saying local governments do not have the authority to make laws that infringe upon the right to bear arms.

Should the lawsuit just filed against Arizona make its way to the Supreme Court, many are speculating that another 5-4 decision may result. To many conservatives who revere the Constitution, it shouldn't be this close. Said Carey, “It is frighteningly obvious that if given the chance, joined by one more, our nation's founding document could be thrown out in favor of radically different view of the world according to Obama.”
